Back Injury
Back injuries can be types of industrial disease.
Many people are involved in heavy manual handling or lifting at work and over a period of time this can often result in back pain, which may create grounds for a compensation claim.
There are two types of back injury claims for compensation:
Single lifting Incidents
This occurs when a person suffers from a back injury as a result of a single lifting incidence.
Lifting over a period of time
This occurs when a person suffers from a back injury which his/her doctor believes may be a result of the job that they do (i.e. heavy lifting) and may have been caused by lifting over a period of time.
Such cases may appear straightforward at first sight, but they are often far more complex, as the condition may have developed over many years, or there may be pre-existing back problems. Also, because we are often dealing with a condition, rather than a straightforward accident, there is frequently no record in an accident book or any other prior documentation. It therefore may appear initially that the claim has been brought too late (i.e. outside the three year period generally allowed for straightforward accidents).
